Estate tax: How does it affect you?

With the Trump administration proposing a new tax plan, the estate tax has been in the news the last few days. We want to take a look at what this tax is, and how it could potentially affect you.

How can I avoid probate?

If you are actively involved in estate planning in California, you may be concerned about your estate being subject to probate. Probate is a very long and often expensive process during which your estate is valued and the validity of your will is determined. While it isn’t always possible to avoid probate, the following tips can reduce the chances of it occurring.

Avoiding battles over an inheritance

When a loved one dies, especially a parent, the last thing you want to do is fight over their possessions. If you have siblings, you’ve probably had your fair share of fights over the years, but now is not the time for a battle.

Probate and gifts to caretakers

No attorney can over emphasize the importance of estate planning in California, but the fact is that many people do not have their assets accounted for in a plan. As the North Bay Business Journal notes, a will is not enough. Without an estate plan, assets that are not in a trust automatically end up in probate, which is a legal process used to decide who the heirs are and how much they inherit after taking debts into account.

The brains of exploited elderly show cognitive differences

Financial exploitation and abuse of our elderly population is a widespread problem. Studies have shown that one out of every 20 people have suffered some form of financial abuse by the age of 60. Considering that people are living longer - and our society is skewing older as a result - that statistic is not only troubling in the present, it could be a harbinger of an even bigger problem to come in the future.
